In a court motion filed on Thursday, the prosecutor’s office said the diversity and inclusion of this community is not tolerated.

In 2008, a man and a woman were arrested by the city’s Office of the Inspector General (OIG). The people involved were arrested for graffiti, a crime that carries a fine of up to 500 and a four-year prison sentence. The police did their research and determined the defendant had never written anything that was offensive.

On July 12, 2009, a man wearing ski masks was arrested by the OIG and sent to the New Orleans Police Department for graffiti, and for possessing a machete in 2012. He’s awaiting trial.

Police said they found no graffiti on the man’s home. They also found graffiti that read Pigs, dogs and bollards.

It is unlawful for graffiti offenders to vandalize buildings, streets and other private property, said OIG Inspector General Mark Leggett. It is unlawful to damage property under the legal definition of graffiti, regardless of whether the property is an existing or recently rehabilitated building. For example, a man or woman can damage a wall that is already standing. Anyone with a machete or machele cannot damage or displace a building. This is an offense punishable by a fine up to 100,000 and a six-year prison sentence.

A police spokeswoman declined an interview request, saying the NYPD is interested in providing community input into the case.

As of Tuesday, a spokesman for New Orleans Mayor Mitch Landrieu had no comment on the situation.

While street graffiti can be harmful, it should not be used as a criminal tool as many have pointed out, said Steve Beecher, a lawyer, in a press release. This should not be used as the excuse for the aggressive policing that is already taking place here.

On Thursday, it was reported that at least one officer had been injured while walking his dog. Landrieu said he was very happy with the work that went into the problem.

My hope is everyone at our department is making a good effort and moving forward in helping the city of New Orleans to make a difference, he said. As we know, the city is more worried about the health of our kids than it is of our officers.
