A federal court is poised to strike down California’s Proposition 187, which would provide greater protections for gay, lesbian, bisexual and transgender people.

In a case on Tuesday (Aug. 31), the U.S. District Court ruled that state law cannot prevent the state from enacting LGBT-inclusive voter ID laws that would have required individuals to show identification while driving or walking down California Highway 15.

It remains unclear how the court will decide to weigh whether a constitutional test is in order to apply to any Proposition 187, though a ruling will be made within 48 hours of receiving the decision.

But the U.S. Supreme Court is expected to take up the case next week. Last week, Chief Justice John Roberts penned a dissent in one of four cases that struck down California’s law because the Legislature could not legally pass its own version of ID.

The decision means the state’s first-ever voter ID law would have to pass through the state Legislature for a yes vote, meaning it could be enforced on a case-by-case basis.

Voters could then make up any state voter ID law they want, but if they don’t get one, they can go through the state attorney general and get a new one from the local government or by filing a petition online.

This allows California voters to easily change the ballot on November 9, making it the first state to make laws allowing for ID requirements.

This decision is a watershed moment when voters in a state where many consider themselves on the LGBT spectrum are turning the U.S. said state Gov. Jerry Brown.

Proposition 187 is currently in the final stages of its legal review, where it could be argued that the law unfairly disadvantages those with mental illness, sexual orientation, gender identity, or the like.

Supporters of the measure argue that it would have guaranteed a more welcoming environment for LGBT people. Many states have made similar efforts, and are now making their own. But others would remain neutral.
