A man is suing a state man, alleging state action against him after state employees allegedly tried to use his cellphone with malicious intent.
Dixie County law forbids companies from using information or devices used by people who are engaged in fraud or to interfere with public health, as defined by state law. But a state judge recently ruled that the law’s definitions are too vague and a phone company has failed to prove the plaintiff’s claim.
The lawsuit is still in its preliminary stages, but Judge Joseph Fertitta in Chicago has given the defendant at least a week to submit. No date is set for the lawsuit to be heard.
The lawsuit, however, is not alone in demanding the city be tougher on companies involved in identity theft and fraud. Last month, a state senator introduced a bill in the state legislature to ban the use of mobile phones for personal information and to force the sale of prepaid cellphones. The proposal was opposed by a number of the state’s lawmakers, including state Reps. Robert T. Waughman, R-Wichita, and Bill Blaylock, R-Nassau.
While the proposed law would have created overburdened criminal prosecution laws, the proposal came after one other measure, which would have made it illegal to charge individuals with making use of a mobile phone without a written authorization from a third party.
The case is being investigated by the U.S. Attorney’s Office’s Office in Dallas.
The man, who requested his last name not be published because of fear of being sued, claims that his contract and bank statements indicated he was a member of the St. Paul police force to protect the public during his time at the Division of Corporations.
