A service grant is defined as an amount from a business, pension plan and other entity (including some government retirement program) which is used for the benefit of the business and to pay for operations. The maximum amount may not exceed an amount described through this section. However, when no income is derived from a service grant, income is not taken into account in using this definition.

Where the employee agrees to pay a service fee or other cost of services (the fee or benefit) without payment of any of the fees or benefits, the business or government plan that pays for the service grants generally will pay for that service. However, if it has decided that such a fee may be appropriate during the service term, the business or government plan will pay if such fee does not exceed the specified statutory and common law value.

A portion of the fee of any fee for a service is used to pay for operations in the taxpayer’s name and place of business within the bounds set forth in this section.

(2) An employee or other independent contractor, or any employer of any of them, is not required to collect taxes.

(b) All fees for service under s. 6 (2) are the same as those imposed by this section if the expense is incurred for any of them or their service is done for money which is otherwise paid to the taxpayer or

(c) Nothing in this part compels the Commissioner to collect any tax and no taxpayer may rely upon any other tax, such as a fee which could be collected by a business or government plan.
